Terms and Conditions
By submitting a shipment (“Shipment”), you (“Sender” or “Customer”) agree to the following Terms and Conditions.
1. Our Services
KUYAS International provides pickup, consolidation, transport, and delivery of goods packaged by the Sender. Shipments may be combined with other customers’ packages. Special services must be requested and approved in writing.
2. Company Authorization
KUYAS International is an FMC-licensed OTI/NVOCC authorized to perform international shipping and freight forwarding services.
3. Sender Responsibilities
The Sender confirms ownership of the goods or authorization from the owner and agrees to complete all required documentation and pay all related fees.
4. Invoice
All invoices issued by KUYAS International are final and non-negotiable. Submitting a Shipment constitutes agreement to these Terms and acknowledgment of financial responsibility.
5. Shipping Rules and Restrictions
Prohibited items include, but are not limited to:
- Firearms, ammunition, explosives
- Illegal drugs or controlled substances
- Alcohol, hazardous materials, perishable goods
- Items from embargoed or restricted countries
Each shipment box must not contain more than 24 units of the same item type or exceed a total value of $500.
KUYAS International may:
- Reject non-compliant Shipments
- Suspend or return Shipments when necessary
- Suspend delivery after unsuccessful attempts, refusal, or incorrect addresses
The Sender is responsible for any additional charges, including storage, customs duties, taxes, and penalties. Shipments may be inspected by X-ray or other methods. Delivery may be withheld for payment issues.
6. Liability Limitations
Liability is limited to $200 per box, unless additional insurance is purchased.
The Sender is responsible for proper packing and sealing.
KUYAS International is not liable for delays caused by events beyond our control (natural disasters, strikes, civil unrest, terrorism, pandemics, government actions).
The Sender agrees to indemnify KUYAS International for any claims or losses resulting from non-compliance.
7. Routing and Subcontracting
Shipments may be routed through intermediate locations and handled by authorized subcontractors, who operate under these Terms.
8. Claims Procedure
Claims must be submitted in writing within the following timeframes:
- Damage or partial loss: within 14 days of receipt
- Delivery delay: within 21 days
- Loss of Shipment: within 60 days
Late claims may be rejected.
9. Entire Agreement
These Terms represent the complete agreement between the Sender and KUYAS International. Modifications must be in writing and signed by both parties. If any provision is unenforceable, the remaining Terms remain valid.
10. Governing Law
These Terms are governed by:
- U.S. Customs laws and regulations
- Applicable state laws
- The Carriage of Goods by Sea Act (COGSA)
- Philippine Bureau of Customs regulations (where applicable)
11. Lien on Shipments
KUYAS International retains a lien on all goods for unpaid shipping charges, duties, taxes, or other fees until fully paid.
12. Declarations and Compliance
The Sender accepts full responsibility for all Shipment contents.
Prohibited items may be seized by authorities.
The Sender may be liable for fines, inspection costs, or damages.
KUYAS International reserves all legal remedies in cases of non-compliance.
By submitting a Shipment, the Sender confirms they have read, understood, and accepted these Terms and Conditions.
