KUYAS Express International

Shipping Policy

By shipping with KUYAS International, the Sender (“Sender” or “Consignor”) agrees to this Shipping Policy.


1. Scope of Our Services
KUYAS International provides collection, consolidation, transport, and delivery of packages (“Balikbayan Boxes” or “Shipments”). Shipments may be consolidated with those of other customers. Special services must be requested and approved in writing.

2. Sender Responsibilities

2.1 Ownership
The Sender affirms ownership of all items or has authorization from the owner.

2.2 Packing
The Sender packs and seals the Shipment and ensures contents match the Packing List.

2.3 Prohibited Items
Shipments must not include:

  • Firearms, ammunition, explosives
  • Illegal or controlled substances
  • Alcohol, hazardous materials, perishable goods
  • Plants, animals
  • Items restricted under U.S. or Philippine law

2.4 Compliance & Legal Responsibility
Illegal or restricted items may be seized by authorities.
The Sender is responsible for fines, inspection fees, legal costs, and damages.
KUYAS International may take legal action for violations.

3. Conditions of Shipping

3.1 Shipment Limits
Each box may contain a maximum of 24 units of the same item type, not exceeding $500 in value (or less if required by law).
Liquids or items that may damage other shipments are prohibited.

3.2 Refusal or Suspension
KUYAS International may refuse, hold, or return Shipments that violate this Policy.
Shipments may be suspended if delivery cannot be completed after reasonable attempts, recipient refusal, or incorrect addresses.
The Sender is responsible for related costs (storage, return fees, inspections).

3.3 Inspection Rights
Shipments may be opened or X-rayed at KUYAS International’s discretion.
Delivery may be withheld for unpaid or declined payments.

4. Liability
Liability is limited to $200 per Shipment, unless additional insurance is purchased.
Senders are responsible for proper packaging; internal damage from poor packing is not covered.
KUYAS International is not liable for delays caused by weather, port congestion, strikes, pandemics, or other events outside its control.
The Sender agrees to indemnify KUYAS International for any claims arising from violations.

5. Subcontracting and Routing
Shipments may be routed through intermediate locations or handled by subcontractors operating under this Policy.

6. Claims
Claims must be submitted in writing:

  • Damage: within 14 days of delivery
  • Delay: within 21 days
  • Loss: within 60 days

Claims submitted after these periods are barred.

7. Governing Law
This Policy is governed by:

  • U.S. law and the Carriage of Goods by Sea Act (COGSA)
  • Philippine Bureau of Customs regulations (e.g., Memorandum Circular No. 79-90)
  • Applicable state and local laws

8. Legal Fees
The prevailing party in any legal action related to this Policy may recover attorney fees and costs.

9. Important Notices to Senders
Senders must provide valid identification.
Shipments must comply with all packing and content requirements.
Delays may occur due to circumstances beyond KUYAS International’s control (port congestion, container shortages, public health issues).


By shipping with KUYAS International, the Sender acknowledges and agrees to this Shipping Policy.
